Prosecution case of Police Chief to Committee
Speaker’s decision came after Kulhudhuhfushi constituency MP Mohamed Nasheed raised questions over the Committee’s decision to seek prosecution of the Police Chief in connection with the arrest of Kaashidhoo constituency MP Abdulla Jabir and Henveiru-south constituency MP Hamid Abdulla Ghafoor for allegedly drinking alcohol on the night of November 15. Nasheed insists that the decision was made in violation of Article 96 of Parliament’s Rules of Procedure. Article 96 of Parliament’s Rules of Procedure states that any report of the Committee on the privileges of MPs must be sent to Parliament floor first. Parliament’s Privileges Committee’s case against Police Commissioner Riyaz was sent directly to PG by the committee. Both MPs were among the 10 people arrested in Haa Dhaal Atoll Hondaidhoo on the night of November 15 for allegedly drinking alcohol. However, they had been released on orders of the Kulhudhuhfushi Magistrate Court. According to the Parliament’s Rules of Procedure no MP can be arrested when a no-confidence motion against the President, members of the cabinet and independent bodies are before the Parliament. However, at the time of the Hondaidhoo arrest, no-confidence motions against President Mohamed Waheed Hassan Manik and President of the Civil Service Commission (CSC) Mohamed Fahmy Hassan had been filed at the Parliament.
