The State initiated the appeal of the thirteen-year prison sentenced handed to former president Mohamed Nasheed by the Criminal Court، for the the High Court to overrule the lower court’s ruling، the legal team of Nasheed claimed.
The legal team of Nasheed made the remark during the preliminary hearing held on the appeal case of Nasheed held at the High Court yesterday.
During the slamming of attorneys of the state and the defendant over the appeal، Nasheed’s defence attorney noted that the State (Prosecutor General) appealing the sentence of Nasheed indicated that the verdict of the lower court has credibility issues.
“[therefore]، we request the High Court to overrule the court’s [criminal court] sentence، if the court’s decision is unconstitutional.”
However، responding to the defence’s statement، State Attorney said the appeal was filed not to get an opinion of the High Court.
“We appealed for the High Court to issue the fitting ruling on the stipulations of the Appeal.”
The State attorneys further said they had not appealed to overrule the lower court verdict، however، the appeal is for the former president Mohamed Nasheed.
The preliminary hearing was concluded with the presiding bench stating their decision on whether to accept the appeal will be notified. However، they did not specify a date.
