HC upholds USD 2 million payment order to Centre Enterprises

High Court has upheld a ruling ordering the state to pay USD 2 million to Centre Enterprises for goods supplied to the Department of Medical Services under the Ministry of Health.
Centre Enterprises had initially filed a civil suit seeking USD 2 million in goods value and an additional USD 3 million in penalties for non-payment.
The Civil Court found that the goods were provided at the agreed price but that payment it was not clear that the payment had been made. The court ordered the state to pay USD 2 million but rejected the request for penalties, as the agreement did not include a clause for non-payment fines.
The state appealed the ruling at the High Court, which ruled by majority decision that there was no reason to overturn the Civil Court’s judgment.
The Civil Court has now given the state one month to settle the payment.
