Hisaan Hussein have said that a criminal investigation cannot be conducted by the police through a constitutional case regarding the elections.
She said that even if a crime has been committed, it should be investigated through the procedures set out in the laws and not through the trial of a constitutional case. In addition, she said that even if President Yameen wants, MNDF does not have the authority to conduct investigations.
Hisaan said that even though the case is based on “elements of magic” so far, no compelling evidence has been submitted which could result in the nullification of the elections.
In addition she said that in today’s hearing the Elections Commission showed a statement by the Commission requesting voters to take their own pens when the EC was accused of planning to use pens with disappearing ink.
Hisaan said that what happens next will be determined when the judges decide whether to accept or reject the confidential witness testimonies submitted on behalf of President Yameen.
