The Maldives Food and Drug Authority (MFDA) has been granted new powers to regulate and take action against unauthorised food advertising, following the implementation of updated regulations under the Food Safety Act.
Published in the Government Gazette on February 20, 2025, the new rules set strict guidelines for food advertising, requiring businesses to submit advertisements for MFDA approval before publication. Any unauthorised advertising or alterations to approved advertisements are strictly prohibited. Additionally, health claims suggesting a food product can treat or cure diseases are no longer permitted.
Strict Penalties for Violations
Businesses found violating these regulations will face severe penalties, with fines increasing based on repeat offences:
First offence: MVR 10,000
Second offence: MVR 100,000
Third offence: MVR 300,000
Subsequent violations: MVR 500,000
The MFDA also has the authority to impose the maximum fine for first-time offences if a business fails to comply after receiving a formal notice.
With the new rules now in effect, the MFDA is empowered to ensure compliance with food advertising standards, preventing misleading or unapproved advertisements and safeguarding public health.
