Hulhumale Court legitimacy case set to begin Sunday

The case of the legitimacy of the Hulhumale Magistrate Court scheduled at the Supreme Court was previously filed by a lawyer at the Civil Court. The case is being tried at the Supreme Court upon request from the Judicial Services Commission (JSC) to take over the case at the lower court. Hence the Supreme Court ordered the Civil Court to forward the documents and files of the case filed with the lower court over the legitimacy of the Hulhumale Magistrate Court. The case submitted at the lower court about a year ago had been delayed due to the Supreme Court order to halt the case until the Supreme Court decides on the matter. The case is scheduled for 2.00pm on Sunday. The case previously submitted to the lower court by Lawyer Ismail Visham is being looked in to by a seven Judge bench including the Chief Justice. Former President Mohamed Nasheed's legal team had also raised procedural points regarding the legitimacy of the Hulhumale Court. Hulhumale Magistrate Court however refused to entertain the claims over the issue of its legitimacy. The High Court earlier ordered a temporary halt of former President Nasheed's trial until the court decides on the appeal of the procedural points raised by Nasheed’s legal team. However the Supreme Court had later issued an order over the High Court to cease its cases regarding the legitimacy issue of the Hulhumale Magistrate Court until a decision over the matter has been reached at the Supreme Court. Hence the former President Nasheed’s case can only resume after the Supreme Court and the High Court decides on the matter respectively. The JSC had requested the Supreme Court to intervene and look in to the case of the legitimacy of the Hulhumale Magistrate Court by a letter even last year. However at the time, the Supreme Court had responded to the appeal stating that such requests should be made through a separate form made available at the court. The case was later submitted through a form during this month.
