Council members won't lose seat on party switch: Supreme Court
According to the Supreme Court verdict, council members losing their seat once they switch to another party was in violation of Article 26 (3) and 30 (1) of the constitution. Hence, the majority of the Judges bench presiding over the case had annulled Article 119 (2) of the Decentralization Act. Article 119 (2) states that if a council member elected on a party’s ticket defects to another party or is axed from the party, that member will automatically lose the seat in the council.
