The homicide case against two people accused of murder by stabbing Ali Hassan (Ayyube) of Dhaalu Kudahuvadhoo Samandharuge has been withdrawn by the State.
The State prosecutor said that although the cases against Fauzan Mohamed of Dhaalu Kudahuvadhoo Fan as, and Ibrahim Majid of Dhaalu Kudahuvadhoo Ranakuri had been brought to court, the investigation regarding the case had been ongoing and that DNA evidence had been sent to Thailand for analysis. He said that the Prosecutor General (PG) wishes to withdraw the case for further review.
“The charges upon Fauzan Mohamed and Ibrahim Majid are for deliberate murder. Prosecutor General wishes to review these charges,” the State Prosecutor said.
The judge granted the prosecutor’s request and asked that they make a speedy review and present the case to the court as soon as possible.
Ayybe was killed in Kudahuvadhoo on the 8 January last year. He was walking down the mosque road when he was ganged up on by a group and stabbed by one of the members in the group. He was then dragged into an abandoned house on the same road named Hudhuali and subsequently stabbed multiple times by three men with knives.
Even though Fauzan and Majid cases have been withdrawn, the State continues the case against Ibrahim Waseem of Maaveli, a step grandson of the victim. He is charged with involvement in deliberate murder. Waseem had confessed to this charge is Court.
On the 13 December last year, Juvenile Court sentenced to imprison the two people convicted of the murder. They are to remain in jail until the 10 year heir of the victim reaches puberty, comes of age and is able to decide on his individual rights. The court however has said that there was not enough evidence against the person who was accused of stabbing the victim, and said that a conviction cannot made.
