Decision to dismiss Nasheed

Hulhumalé Court has responded to Prosecutor General’s (PG) Office’s request to review its decision to dismiss Nasheed’s case, by saying that reconsideration is not possible unless the decision is annulled by a higher Court.
An official of Hulhumalé Court said today that the PG Office has been informed of this decision by the Hulhumalé Court Magistrate.
Hulhumalé Court earlier cited that it has no jurisdiction over Nasheed’s case and returned it to PG Office; which was followed by PG Office’s request based on article 66 and 69 of the law on courts, for Hulhumalé Court to review its decision.
The decision that Hulhumalé Court has no jurisdiction over Nasheed’s case was made by its Acting Magistrate, as the Hulhumalé Court Magistrate Shiyama Mohamed was on vacation at the time.
Chief Judge of Criminal Court Abdullah Mohamed of Bahaaruge, R. Hulhudhuffaaru, was arrested by MNDF on 16 January 2012, and subsequently detained at the MNDF training facility Girifushi.
PG Office has pressed charges against former President and Commander-in-Chief Mohamed Nasheed, former Defence Minister Thalhath Ibrahim Kaleyfaan, former Chief of Defence Force Moosa Ali Jaleel, former Brigadier General Ibrahim Mohamed Didi and Colonel Mohamed Ziyad in relation to this crime.
