Supreme Court declines to block enforcement of seat loss rule

The Supreme Court has ruled that it cannot issue an order that prevents Members of Parliament from losing their seat if they change parties, are expelled from their parties, or if an independent Member of Parliament joins a party.
Former parliamentarian Ali Hussain filed a case in the Supreme Court challenging a constitutional amendment that allows parliament members to lose their seats under such circumstances. He also requested a temporary order to prevent any action that would remove parliamentarians from their seats, as well as action against the judges hearing the case.
The Supreme Court said an interim order cannot be granted as it would affect the core issue of the case. It also rejected the request regarding the judges, stating it would go against the principle that judges cannot rule on matters involving their own interests.
The case is being heard by a seven-judge bench led by Chief Justice Abdul Ghanee Mohamed.
