High Court rejects appeal by PG on ex-president Nasheed’s sentence

The High Court of Maldives has rendered its verdict on the appeal application filed by the Prosecutor General regarding the Criminal Court’s conviction of former President Mohamed Nasheed on 13 March 2015.

Nasheed was convicted on 13 March 2015 and sentenced to 13 years in prison for ordering the unlawful abduction and arbitrary detention of a judge.
The decision to not to accept the appeal came after a preliminary hearing held on 9 September 2015. In the preliminary hearing the High Court Bench heard legal submissions from the State Prosecutors while Mr. Nasheed and his legal team demonstrated a clear lack of commitment to the appeal process.
The Prosecutor General filed six grounds of appeal as argued by Mr. Nasheed’s legal team and further requested the High Court to rule on whether the alleged procedural irregularities in the trial process rendered the conviction unsafe.
According to the decision، the High Court of Maldives considered the grounds of appeal submitted by the Prosecutor General and held that there was no evidence to question the process or the credibility of Judges.
The verdict further stated in addition to the above، that the grounds of appeal set out in the Prosecutor General’s application were not consistent with the conditions of appeal as provided for under clause 43 of the Judicature Act (Law no. 22/2010).
