Former President Mohamed Nasheed has filed a case to Civil Court, questioning the legitimacy of the bench of judges appointed by Judicial Service Commission (JSC) to preside over the case against him in Hulhumalé Court.
Initially, Nasheed’s case claiming that the constitution of judges by JSC to Hulhumalé Court was unlawful, was filed to High Court. It was dismissed this morning by High Court, which said that it was not within the court's jurisdiction.
Nasheed’s lawyer Ahmed Abdulla Afeef told reporters after submitting the case to Civil Court today that JSC does not have the authority to appoint judges to preside over a particular case.
Nasheed has been accused by the State of arresting an innocent person, after his administration through Maldives National Defence Force (MNDF) arrested Chief Judge of Criminal Court Abdulla Mohamed.
