The Civil Court has rendered a decision against Major General (retd) Wais Waheed regarding the seizure of a flat allocated to him under the Sifainge Corporation (SIFCO) housing project, which provides accommodation for military personnel.
Waheed, who currently serves as the Director General of the National Counter Terrorism Center (NCTC), initiated legal proceedings against SIFCO last year. His suit alleged that following opening of applications for SIFCO flats on November 28, 2013, he submitted an application for a flat within the SIFCO Hiyaa project. He claimed that his application and initial payment were accepted, a certificate of receipt for the flat was issued, and a flat agreement for unit C1301 was duly signed.
However, despite the signed agreement, SIFCO subsequently opted not to hand over the flat, citing discovery that Waheed owned 600 square feet of land in Male’ city. This led Waheed to seek judicial intervention to secure the flat.
Civil Court Judge Abdul Nasir Shafeeq issued a ruling this week, emphasizing a condition stipulated in the SIFCO flat agreement: that buyers owning more than 600 square feet of land in the Male' area (which includes Male', Villimale', Hulhumale', Gulhifalhu, Thilafushi, and Giraavaru lagoon) must relinquish said land prior to signing the agreement. The judge further noted that the agreement explicitly states that any incorrect information provided by an applicant regarding their land and flat ownership would result in the termination of the housing agreement. In light of this, the court concluded that "the agreement has been terminated."
