The Police have informed that despite the Court order to the Police to produce former President Mohamed Nasheed in Court today for the trial on the illegal arrest of Chief Judge of Criminal Court Abdullah Mohamed, it is not possible to do so due to Nasheed’s refusal to comply with the Court order.
The Police made this announcement moments ago at a press conference.
The Police have been ordered by the Court to produce Nasheed in Court at 4:00pm today.
The Police said yesterday in a press statement that the order by Hulhumale’ Court was not an order to produce Nasheed in Court by keeping him in detention, thus Nasheed can only be produced in Court with his consent.
The statement also said that the usual orders by Courts to the Police to produce persons in Court follow article 17 of the regulation on Court summons, which stipulates that persons can be detained in order to produce them in Court.
However the Hulhumale’ Court order was made under article 5(b) of the regulation on Court summons, and because it ordered the Police only to produce him in Court, the Police are of the view that Nasheed can be produced in Court only if he is willing to appear in Court as summoned.
