The Supreme Court has scheduled to look into a constitutional case on Monday amidst circulating rumors that the government is seeking to file at the top court to amend laws such that lawmakers will lose their seats in Parliament should they shift political parties or go against the party’s whip line.
However, the court has not disclosed details of the case.
Since Friday, Supreme Court’s Judge Ali Hameed has been hospitalised. According to the Constitution, constitutional cases should be looked into by Supreme Court only with their full bench. The exception to the rule is only in a situation of legal vacuum in the country.
According to sources, Monday’s constitutional case is taken by the three-member bench comprising Chief Justice Abdulla Saeed, Judge Adam Mohamed Abdulla and Judge Ahmed Abdulla Didi.
The case was filed by Attorney General Mohamed Anil on behalf of the government. However, the Prosecutor General has not given any statements regarding the matter.
The unknown case is filed as an ex parte motion without a defendant.
