Nasheed to appeal arrest

Attorney Hisaan Hussein, speaking in an interview with Rajje TV on behalf of the legal team said that the team was in High Court to see if the case would be accepted by High Court on Sunday night. “We are hoping the case will be accepted into High Court tonight. But High Court hasn’t said anything yet,” she said. Hisaan said the legal team believed the arrest warrant to be issued unlawfully, and that the arrest warrant did not fulfil legal requirements. “The warrant was issued said terrorism charges, that he may not attend court and attempt to flee trial. In reality, it is unclear to this day to us, and to President Nasheed himself whether any of the charges in the warrant was ever raised. This had not taken place,” said Hisaan. The arrest warrant was issued based a letter by Prosecutor General, and a police intelligence report; while law and rules state that a warrant for fear someone may try to flee an ongoing trial is to be issued as a measure against the person if he/she fails to honour court summons, said Hisaan. “This case is not in investigative stage. No investigation is ongoing on the case at the moment. According to them, charges have already been pressed,” she said. Though hearing on President Nasheed’s trial has been scheduled for 4:00 at Criminal Court Monday evening; Hisaan said that neither President Nasheed nor any of his lawyers had been informed of the fact. Hisaan said that she did not believe that according to Criminal Court regulation, hearings could be scheduled without informing the defendant. “Regulation states that either the defendant or his lawyers need to submit an application form two days beforehand,” she said, adding that it would take at least two more days to process the application. She said that carrying out trial on Monday would deprive him of the right to a defence lawyer. Prosecutors had retracted previous charge of “arresting an innocent man” last Monday, and raised terrorism charges against President Nasheed which could land him a 10 to 15 year prison sentence. The charges have been raised for detention of Criminal Court Chief Judge Abdulla Mohamed during his administration. Others charged with terrorism in relation to the case are current Defence Minister Major General (Retired) Moosa Ali Jaleel, MP Ibrahim Mohamed Didi – who had been Maldives National Defence Force (MNDF) Male’ Area Commander, Tholhath Ibrahim Kaleyfaanu – who had been Defence Minister at the time, and former Colonel Mohamed Ziyad.
