WGAD’s opinon on Nasheed’s case ‘not acceptable’

The Government of Maldives has stated that it does not accept the opinion of the United Nations Working Group On Arbitrary Detention on former president Mohamed Nasheed’s case. UN WGAD stated that they believe former president was detained unlawfully.
Foreign Ministry has issued a statement on the matter last night، while the complaint was filed at the group by the former president on April 30th، and the group’s decision was submitted to the government on September 17th.
The statement read that the findings of the WGAD are to be published by the government in the interests of transparency.
The group has urged the government that the matter should be taken seriously into consideration.
Moreover، the government assured to continue the engagement with the Group on the matter، however، said that it does not accept the decision of the WGAD and will not be made to act on the basis of a non-binding opinion.
 
Government said that there is no requirement for the petitioner to exhaust all domestic remedies prior to submitting a petition، however it must be noted that the domestic process is still on-going and that those issues raised by the former President are capable of being rectified on appeal despite his position of non-engagement.
In addition، Government noted that despite the former President refusing to engage in the process and making clear attempts at sabotage، the Prosecutor General sought to have the matter considered and ruled upon by the High Court.
The Prosecutor General has now filed a further appeal with the Supreme Court.
