State has requested the Supreme Court to dissolve the clause in Political Parties Act which allows officials elected to posts as candidates of a particular political party to retain their posts even if they leave the party.
Supreme Court, this Wednesday, held a hearing in the trial of Vilingili MP Saud Hussain, who has filed a motion to retain his seat at the parliament.
The State, during the hearing, asked Supreme Court to dissolve Article 16 (e) of Political Parties Act.
Article 16 (e) of Political Parties Act:
An individual elected in an election held in Maldives in compliance with the Maldivian Constitution and law as a candidate of a particular political party shall retain his/her seat even if dismissed from the party for violation of ethical conduct.
The State made the request arguing it clashed with the Supreme Court ruling which says any parliamentarian elected a candidate of a particular political party will lose his/her seat if the parliamentarian leaves the political party of switches parties.
