Employment Tribunal has ruled that Male’ City Council’s former Secretary General Wajeeh Naseer was dismissed from his post unlawfully.
Naseer was dismissed from his post on August 15, 2024, in a no-confidence motion proposed by then-Deputy Mayor Ahmed Nareesh. The ruling party-dominated Male’ City Council approved the motion with the votes of all councilors in attendance except two: North Galolhu Councillor Mohamed Saif Fathih and West Galolhu Councillor Mariyam Nazima Mohamed Faiz, who back then represented The Democrats.
Naseer subsequently filed a wrongful dismissal case with the Employment Tribunal.
The Employment Tribunal delivered its ruling in the case last Wednesday, following a year-long trial. In this regard, the Tribunal had ruled that Naseer was dismissed without establishing the substantive fairness required under the Employment Act when dismissing an employee.
The respondent in Naseer’s case is the Civil Service Commission.
Employment Tribunal had mainly attributed its decision to failure to provide Naseer with the opportunity to respond to the allegations raised against him by Nareesh.
The Tribunal had awarded compensation for Naseer for his wrongful dismissal before the expiration of his contract. In this regard, he was awarded MVR 239,026, which accounts for his salary and allowances from the date of his dismissal to the date he received a new job.
The Tribunal has ordered to settle the payment within 30 days, excluding overnment holidays.
The case was presides by Employment Tribunal’s Vice President Fathimath Maheera.
