The State cannot press charges a second time against the former President Mohamed Nasheed allegedly for imprisoning Criminal Court Chief Justice Abdulla Mohamed on unlawful grounds، says Maldivian Democratic Party (MDP).
Though PG Office did not inform if they are to re-prosecute Nasheed after withdrawing the charges against him on Monday، MDP has stated Nasheed cannot be re-prosecuted.
MDP on a press statement released today said the case against Nasheed is a politically motivated case and the intention of the Government is clear as one of the defendants along with Nasheed in the case is currently the Defence Minister.
“While the State had retracted the charges pressed against President Nasheed in 2012، both the party and President had to face several complications because of it. It is believed that there are no solid proofs that President Nasheed could be prosecuted for a criminal offence، as the charges have been retracted after prosecuting him irresponsibly، And this depicts that the State only executed this for a political purpose”، the statement read.
MDP further said، in light of the ‘transparency and fairness’ emphasized by the Constitution، and as there are many pending cases to be prosecuted، it is unfair and against the spirit of the Constitution to only push the prosecution of President Nasheed.
The opposition party on the statement urged the Prosecutor General not to proceed with the re-prosecution of President Nasheed for it may create a unrest within the public and as the majority is against the re-prosecution of Nasheed.
Prosecutor General’s Office on Monday withdrew charges pressed against Nasheed for further evaluation and investigation، along with the charges pressed against other individuals in the case، including the current Defence Minister Major General (Retired) Moosa Ali Jaleel، who was the then Chief of Defence Force.
