Criminal Court has said that they cannot accept the case submitted by lawyer Mahfooz Saeed requesting an order to release his client Colonel Fayaz Ali Riyaz (Papa) who was arrested in relation to the explosion on board the Presidential launch.
Lawyer Mahfooz told Sun Media today that the Criminal Court rejected that case because the Ministry of Defence and National Security sent a letter to the court saying that Colonel Riyaz is not detained in any of their buildings.
Although the Defence Ministry has said this, the Head of MNDF Armory and Special Protection Group (SPG) “Papa” has not been since 11 October by his family or anyone of the general public.
After submitting his case to the court, Mahfooz said that while Article 48 of the Constitution dictates the procedure on detainees, Colonel Riyaz been relieved of all those rights.
But he has information that his client is being questioned and investigated in different crimes.
Mahfooz said that the cause of his client’s detention has not been notified to the family.
