The case of the former president Mohamed Nasheed’s transfer back to the Maafushi Prison from house arrest، has been rejected by the Judge’s Council at the Criminal Court.
The Court’s Registrar rejected the Hebeas Corpus case submitted by President Nasheed’s legal team regarding his transfer back to Prison. The Judge’s Council of the court says they support the decision by the Registrar.
Under regulations، the Registrar’s decisions can be appealed at the Judge’s Council of the court. However، the Registrar of the Criminal Court has said that President Nasheed’s case cannot be accepted under Article 60-B of the Law of Courts.
Nasheed’s legal team submitted the case claiming that a letter from the Correctional Service states that President Nasheed was transferred to house arrest for the remainder of the 13 year prison sentence passed on to him by the Criminal Court on March 13، following being found guilty of terror charges pressed against him for kidnapping criminal court chief justice Uz. Abdulla ‘Gaazee’ Mohamed in 2012.
While the Police are investigating the claimed transfer document، Correctional Service has refuted the legibility of the document، and said the authority has not issued such a document.
