The defence attorneys of the former President Mohamed Nasheed had sent a letter addressed to the Prosecutor General following the withdrawal of charges against Nasheed for imprisoning Criminal Court chief justice Abdulla Mohamed on unlawful grounds.
The legal team of Nasheed said on the letter that President Nasheed cannot be prosecuted with regards to the Constitution، Islamic Shariah and fundamental rights of a democratic society.
All the documents and evidences regarding the case points out to that the State cannot press charges against Nasheed on the said accusation، the legal team said.
Furthermore، the legal team had said on their letter to PG that withdrawing the charges pressed against Nasheed is not an authority granted to PG by the Constitution or the Prosecutor General’s Act.
In addition the legal team of Nasheed had noted that due to the prolonged case against Nasheed، for the past three years، without any remarkable proceedings، and several times Nasheed facing arrests، it has caused several negative affect on both his political career and his fundamental rights.
