High Court upholds lower court decision on Hulhumale' Land Registry case
Male' City Council abruptly revoked Hulhumale' registration under HDC in December last year after HDC obstructed a rally of opposition PPM. HDC issued a stay order to delay the city council's decision until the case is over.
Delivering the verdict at a hearing held at the High Court yesterday, Judge Ali Sameer said if a temporary order was not issued, HDC could have suffered irreparable damages.
The judge said that this was due to transactions carried out by HDC regarding land based on the Hulhumale' registration. Judge Sameer also noted that it also included third party rights.
He said that the damages caused to HDC by not issuing a temporary order would be greater than the damages caused to the city council. Judge Sameer said that he supported the Civil Court order.
In addition to Judge Sameer, the case was presided over by High Court Judge Mohamed Niyaz and Judge Mohamed Faisal. Judge Sameer presided over the bench.
